The purpose of the Legal Notice of www.rift-agency.com is to comply with the information obligation imposed on all service providers by Article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, as well as to establish the rules for the use of the Portal that will apply to all users as a result of its use.

1. Who We Are

In accordance with the provisions of Article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter referred to as the “LSSI”), we inform you that the website located at www.rift-agency.com (hereinafter referred to as the “Website” or the “Portal”) is operated by the company RIFT TALENTOS S.L. (hereinafter referred to as “Rift Agency”), with Tax Identification Number B-06825640, registered in the Commercial Registry of the Community of Madrid, and with its registered address at Calle Alcalde Henche de la Plata 7, 28050, Madrid. 2. Content of the Legal Notice
2.1 Acceptance of the Legal Notice

This Legal Notice regulates the use of the information society services made available to users of the Internet through the Website. Accessing and using the Website by the user (hereinafter, the “User”) implies their full acceptance and commitment to fully comply with the terms and conditions set forth in this Legal Notice, as well as in the Privacy Policy of the Portal.
Furthermore, we inform the User that in order to participate in the services and functionalities provided by Rift Agency through the Portal, it is necessary to register as a registered user of the Website (hereinafter, “Registered User”). The aforementioned services and functionalities are governed, in addition to this Legal Notice, by the general terms and conditions that the User must accept prior to their registration as a Registered User (hereinafter, “Terms of Use”).
Additionally, through the Portal, the User can, among other things, become a member, collaborator, or volunteer of Rift Agency, make donations in favor of Rift Agency, and participate in fundraisers and campaigns organized by Rift Agency. Participation in these activities is subject to specific conditions or instructions that must be accepted by the User and that, as indicated in each specific case, replace, supplement, and/or modify this Legal Notice.

2.2 Conditions of Use of the Portal

Access to the Website is free, except for the cost of connection through the telecommunications network provided by the access provider contracted by the User.
The User undertakes not to use the Website for fraudulent purposes and not to engage in any conduct that could damage the image, interests, and rights of Rift Agency or third parties. Likewise, the User undertakes not to take any action that could damage, disable, or overload the Website, or interfere or hinder, in any way, its normal use and operation.
The User is informed that in the event of non-compliance with the content of this Legal Notice, the Privacy Policy, the Terms of Use, or any other specific terms or conditions set forth in the Portal, Rift Agency reserves the right to limit, suspend, or terminate the User’s access to the Website, taking any technical measures necessary for that purpose. Additionally, Rift Agency reserves the right to exercise such measures in the event it reasonably suspects that the User is violating any of the terms and conditions set forth in the aforementioned documents.
Finally, we inform the User that Rift Agency reserves the right, at any time, to decide on the continuity of the information society services it provides through the Portal.

2.3 Intellectual and Industrial Property

The intellectual property rights to the arrangement of the contents of the Portal (sui generis right over the database), its graphic design (look & feel), the underlying computer programs (including source codes), as well as the various elements that make up the Portal (texts, graphics, photographs, videos, sound recordings, etc.), hereinafter referred to as the “Contents,” belong to Rift Agency or its licensors. As for the distinctive signs included in the Portal (trademarks and trade names), they are the property of Rift Agency or its licensors. The use of the Portal by the User does not imply the transfer of any intellectual and/or industrial property rights over the Portal, the Contents, and/or the distinctive signs of Rift Agency. Accordingly, through this Legal Notice, except in cases where it is legally permitted or authorized by Rift Agency, the User is expressly prohibited from reproducing, transforming, distributing, making available to the public, extracting, and/or reusing the Portal, its Contents, and/or the distinctive signs of Rift Agency.

2.4 Linking Policy (“Links”)

2.4.1 Establishment of links to the Portal

The establishment of links to the website is prohibited unless prior authorization has been obtained from Rift Agency. In any case, once the link has been authorized by Rift Agency, it must be established under the following terms:
The link will only connect to the home page or main page of the Portal.
The link may not consist of frames or frames that allow the display of the Portal through Internet addresses different from those of the website or that in any other way display the information of the Portal together with that included on other web pages.
No false, inaccurate, or incorrect statements about the Portal and/or Rift Agency shall be made from the linking website (hereinafter, the “Linking Site”).
Under no circumstances shall it be stated on the Linking Site that Rift Agency has given its consent for the insertion of the link or that it sponsors, collaborates, endorses, supervises, or approves the content and/or services provided through the Linking Site.
The Linking Site must comply faithfully with the law and may not host any content, whether its own or third-party, that: (i) is unlawful, harmful, or contrary to morality and good customs (pornographic, violent, racist, etc.); (ii) induces or may induce the User to have a false conception that Rift Agency subscribes to, endorses, adheres to, or in any way supports the lawful or unlawful ideas, statements, or expressions of the sender; and (iii) is inappropriate or irrelevant to the activities of Rift Agency. (i) sean ilícitos, nocivos o contrarios a la moral y a las buenas costumbres (pornográficos, violentos, racistas, etc.); (ii) induzcan o puedan inducir en el Usuario la falsa concepción de que Rift Agency suscribe, respalda, se adhiere o de cualquier manera apoya, las ideas, manifestaciones o expresiones, lícitas o ilícitas del remitente; y (iii) resulten inapropiados o no pertinentes con la actividad de Rift Agency .

In the event of non-compliance with any of the aforementioned terms, Rift Agency will proceed immediately and without prior notice to remove the link.

2.4.2 Linked Sites

In order to help you find additional information, we have included various technical linking devices that allow the User to access other websites (hereinafter, “Linked Sites”). In these cases, Rift Agency acts as an intermediary service provider, as provided in article 17 of the LSSI. In accordance with the aforementioned legislation, Rift Agency shall not be liable for the services and content provided through the Linked Sites, unless it has effective knowledge of their unlawfulness and fails to disable the link with due diligence.
Under no circumstances does the existence of Linked Sites imply endorsement, promotion, identification, or agreement by Rift Agency with the statements, content, or services provided through the Linked Sites. Consequently, Rift Agency is not responsible for the content of the Linked Sites or their terms of use and privacy policies. It is the sole responsibility of the User to check and accept them each time they access and use them.
If the User believes that the Linked Sites contain unlawful, harmful, denigrating, violent, or inappropriate content, they may notify Rift Agency by email at the following address: legal@rift-agency.com. However, such communication shall in no way imply Rift Agency’s obligation to remove the corresponding link, nor does it necessarily imply Rift Agency’s effective knowledge of the unlawfulness of the content of the Linked Site, for the purposes of the applicable regulations.

2.5 Reporting of illicit or inappropriate content

As stated in section 2.1 of this Legal Notice, prior registration as a Registered User is required to participate in the services and functionalities of the Portal (Rift Agency Social Network, forums, blogs, etc.). However, non-registered users can still access the contents included by Registered Users in relation to their participation in the mentioned services and functionalities. In this regard, if a user notices that illicit, harmful, morally objectionable, contrary to customs and practices, or inappropriate content has been included on the Portal, considering the principles, purposes, and activities of Rift Agency, they may report this situation by using the following email address: legal@rift-agency.com However, such communication does not necessarily imply an obligation for Rift Agency to remove the corresponding content or information, nor does it necessarily imply the effective knowledge of Rift Agency regarding the illegality of the content on the Linked Site, for the purposes established by current regulations.

2.6 Rift Agency’s Responsibility

The User acknowledges and accepts that, although Rift Agency makes its best efforts to ensure the accuracy of the content and information included on the Website, they are of a general and purely informative nature. The same applies to the information regarding health and medical treatments made available to the User through the Portal, with such information in no way constituting a recommendation by Rift Agency for Users to undergo specific treatments. Therefore, Rift Agency is not responsible for the decisions made by the User based on the information provided through the Website, nor for any damages or harm suffered by the User or third parties as a result of actions based on information obtained from the Website.

On the other hand, through features such as the Rift Agency Social Network, opinion forums, blogs, etc., Rift Agency offers Registered Users the possibility to include information and content on the Portal. In this regard, Rift Agency makes its best efforts to review that the information and content included on the Portal by Registered Users does not contain illicit, derogatory, defamatory, violent, or harmful content, nor is contrary to the law, ethics, morals, good customs, or the principles of Rift Agency. However, given the material impossibility of conducting exhaustive reviews, the publication on the Website of the information and content provided by Registered Users should not, in any way, be interpreted or understood as approval, recommendation, promotion, identification, or agreement by Rift Agency with the published information or content. Thus, Rift Agency will not be responsible for the information and content included by the Registered User on the Website, with the User being solely responsible for the consequences that may arise from their inclusion of illicit information or content on the Portal.
Notwithstanding the above, Rift Agency reserves the right, as stated in the Terms of Use, to remove at any time the information or content included by the Registered User on the Website, if it deems them potentially illicit, inappropriate, or inadequate, or not in line with the principles, purposes, goals, and activities of Rift Agency. Furthermore, accessing the Website does not imply any obligation on the part of Rift Agency to control the absence of viruses, worms, or any other harmful computer elements. It is the User’s responsibility, in any case, to use appropriate tools to detect such harmful elements. Consequently, Rift Agency will not be held responsible for any damages caused to the User’s or third parties’ computer equipment through the provision of services via the Website.
The availability of the service requires third-party services and supplies, including telecommunications network services whose reliability, quality, and operation are not under the control of Rift Agency. Therefore, Rift Agency does not guarantee the availability of the Website, and the services provided through it may be interrupted, suspended, or canceled at any time. In particular, Rift Agency is not responsible for any damages or losses of any kind suffered by the User as a result of the unavailability of the Website, especially those resulting from telecommunication network failures. Additionally, Rift Agency reserves the right to review the Website or deny access to it at any time.

2.7 Data Protection

As stated in section 2.1 of this Legal Notice, the aspects related to the processing of Users’ personal data in connection with the use of the Portal are governed by the Privacy Policy, as well as the legal texts attached to the various data collection forms included on the Portal.

2.8 Miscellaneous

In accordance with Article 3 of the LSSI, the laws applicable to the information society services provided by Rift Agency through the Portal shall be those of the Kingdom of Spain. If any of the provisions contained in this Legal Notice are declared null and void, it shall be removed or replaced. In any case, such declaration of nullity shall not affect the validity of the remaining provisions set forth in this Legal Notice.
